Champlain Man Arrested After Alleged Domestic Assault Witnessed by Child

Details of the Incident
A late-night domestic dispute in the village of Champlain led to the arrest of a 36-year-old man on multiple charges, including assault and endangering the welfare of a child.
According to a statement from the New York State Police, troopers responded to a call around 10:45 p.m. on June 10, 2025, regarding a domestic incident on Route 9 in Champlain. The preliminary investigation revealed that the situation began as a verbal argument but escalated into a physical altercation.
Police report that during the incident, the suspect, identified as Herbert R. Perez of Champlain, allegedly bit the victim, causing small lacerations. Importantly, a child was present and reportedly witnessed the assault.
Emergency medical personnel from Champlain EMS arrived on the scene and evaluated the victim. However, the victim declined transport to the hospital for further care.
Charges Filed
Following the investigation, Perez was taken into custody by State Police and transported to the SP Champlain barracks for processing.
He has been charged with:

Assault in the Third Degree, a Class A misdemeanor under New York Penal Law §120.00, which applies when someone intentionally or recklessly causes physical injury to another person.

Endangering the Welfare of a Child, another Class A misdemeanor, often charged when an adult’s actions potentially harm a child’s mental, emotional, or physical well-being—particularly when they are exposed to acts of violence.
Perez was later arraigned in the Town of Mooers Court and subsequently released.
